Bring Your Cuban Spouse to the USA
You’re halfway there. Your marriage to your Cuban spouse is done. And now comes the green card process. This is where you and your spouse apply for a visa, so they can immigrate to America and obtain their green card.
There are two ways to bring your Cuban spouse to the USA:
Immigrant visa for a Spouse of a U.S. citizen: you the sponsor fill out a Petition for Alien Relative – form I-130 – at the Department of Homeland Security. This is usually done by you back home in America rather than from abroad. In some cases, you can file an Immigrant Petition outside the United States.
The USCIS will process your petition. Once approved, it is sent to the National Visa Center.
Next your spouse will attend a Visa Interview back in Cuba.
Finally your spouse will receive their immigrant visa.
Non-immigrant visa for spouse (K-3): an application for a K-3 visa must be filed in the country in which the marriage took place. You must file in Cuba for a K-3. Once the K-3 visa is issued, you both then travel to the USA where you await the further processing of your Cuban spouse’s application for lawful permanent residence (green card).
